This document is an English translation of the original French Terms and Conditions. While we have made every effort to ensure the accuracy of the translation, the original French version is the legally binding document. In case of any discrepancies or disputes, the French version shall prevail.
PURPOSE
These General Terms and Conditions of Sale (hereinafter referred to as the “T&Cs”) govern the relationship between TEXPLAINED and its customers regarding the sale of products via the website www.texplained.com/store or www.store.texplained.com.
ACCEPTANCE
By placing an order on the website, the customer declares that they have read and fully accepted the General Terms and Conditions of Sale and the Legal Notice presented to them. The T&Cs shall prevail over any other terms, unless a prior written agreement is reached between the parties.
PRODUCT SPECIFICATIONS
The essential characteristics of the products (description, usage, etc.) are provided on each product page. For any additional information about a product, the customer is invited to contact TEXPLAINED before placing an order by email at contact@texplained.com. TEXPLAINED commits to responding as soon as possible to provide the requested information. The intellectual property rights associated with the products supplied are detailed in the Legal Notice : https://www.texplained.com/store/ln/.
USE OF PRODUCTS
The online courses offered on this site are accessible only via streaming (online viewing) for a period of one (1) year from the first opening of a lesson by the user. After this period, access to the videos will be automatically deactivated without the possibility of extension, unless prior written consent is obtained from TEXPLAINED.
The educational resources associated with the courses (PDF files) are downloadable by the user and remain accessible without time limitations, subject to compliance with the terms of use described below. Digital resources sold separately (such as chip images and reports) are immediately downloadable after purchase and are not subject to any access time restrictions.
WARRANTIES AND LIABILITIES
TEXPLAINED commits to providing continuous and high-quality access to the courses and digital resources, within the limits of technical constraints inherent to the use of the Internet. However, TEXPLAINED cannot be held responsible for access interruptions due to technical issues beyond its control (maintenance, server outages, user connection problems, etc.).
The user is responsible for the safekeeping of downloadable files (PDFs, chip images, reports, etc.). TEXPLAINED cannot be held liable for any loss or damage related to these files after their download.
The video content is protected by a DRM (Digital Rights Management) system to ensure its security and compliance with the terms of use. For an optimal experience, it is recommended to use the Google Chrome browser to access the videos.
PRICING
- Products are displayed with a price in euros excluding tax (HT) on the website. The final amount, including taxes and applicable fees, is calculated and communicated before the order is finalized, based on the customer’s delivery address.
- Delivery fees are clearly indicated during the order process and remain the responsibility of the customer, unless otherwise stated. Digital products, which do not require physical shipping, are not subject to delivery fees.
- TEXPLAINED reserves the right to modify its prices at any time, but products will be invoiced based on the price in effect at the time of order validation.
PAYMENT METHODS
The accepted payment methods are as follows:
- Credit card (CB, Visa, Mastercard) via the Revolut payment gateway (https://www.revolut.com/business/payment-gateway/);
- Apple Pay, in accordance with Apple Pay’s general terms of use available at: https://www.apple.com/legal/internet-services/apple-pay-wallet/ ;
- Google Pay, in accordance with Google Pay’s general terms of use available at: https://payments.google.com/payments/apis-secure/ ;
Payment is due immediately upon order validation. Installment payments are not offered on the website.
DELIVERY
- Delivery times: Delivery times are indicated on each product page and confirmed during the order process. Digital products are available immediately after payment confirmation, via a hyperlink allowing the user to download their content.
- Delivery fees: Delivery fees are calculated based on the weight, destination, and chosen delivery method. Digital products are not subject to delivery fees.
- Order tracking: A tracking number is provided to the customer upon shipment of the order. Digital products do not have a tracking number.
RIGHT OF WITHDRAWAL
DIGITAL GOODS
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content not provided on a physical medium, where the performance has begun after the consumer’s prior consent and explicit waiver of their right of withdrawal. Payment for a digital product (such as a course or downloadable file) constitutes the Customer’s waiver of their right of withdrawal. The customer is informed of this and consents by checking the corresponding box during the payment process.
PHYSICAL GOODS
In accordance with French legislation, the customer has a period of 14 days to withdraw from the contract without providing a reason or incurring penalties. This period begins the day after receipt of the product for physical goods, or from the conclusion of the contract for services.
WITHDRAWAL PROCEDURE
- The customer must notify their decision to withdraw by email to contact@texplained.com.
- The refund will be processed within 14 days of receipt of the returned products or notification of withdrawal for services.
DISPUTE RESOLUTION
- Any complaint must be submitted by email to contact@texplained.com. TEXPLAINED commits to responding within 14 business days.
- Since January 1, 2016, if a dispute persists between us after attempting to resolve it with our customer service, and subject to the admissibility conditions provided by the Consumer Code, you have the option to refer the matter free of charge to the competent Consumer Mediator (https://www.economie.gouv.fr/mediation-conso/mediateurs-references). Their role will be to facilitate an amicable agreement between the Parties.
- The consumer also has the option to use the European Union’s online dispute resolution platform (https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage).
GOVERNING LAW AND JURISDICTION
These General Terms and Conditions of Sale are governed by and interpreted in accordance with French law. In the event of a dispute, and in the absence of an amicable resolution, the competent courts shall be those of the Tribunal de Grasse.
SEVERABILITY CLAUSE
If any provision of these T&Cs is deemed invalid, the remaining provisions shall remain fully applicable.
